Event Description: With the California Employee Ownership Act recently passed and pro-ESOP legislation in place, ESOPs are primed to pave the way for other western states to follow suit. Even the U.S. Department of Labor launched the Employee Ownership Initiative within its Employee Benefits Security Administration that will support the creation and expansion of worker-owned businesses. Whether an s-corp or c-corp, government regulation affects every aspect of your ESOP structure. Communicating your needs and concerns to your elected officials can seem intimidating to employee owners who have little or no experience in the government area. In this discussion, we will explore relatively easy ways to make your voices heard in the halls of congress. This session will also provide tools and resources for fostering dynamic workplace cultures that attract and retain top talent as well as discussion around developing strategies to build a pro-ESOP community within and around the western states.

Event Description: What happens when you receive that dreaded audit letter from the Department of Labor (DOL) or Internal Revenue Service (IRS)? First, take a deep breath. Next, make note of any deadlines prescribed within the letter for response to the items being sought under the examination. Review the audit letter thoroughly. Whether you plan to handle the examination yourself or enlist the help of others, understanding the process and steps from beginning to end of the review helps for a smooth experience. Your documentation will be critical to a swift resolution of the examination. Once your plan is under review, if there are plan corrections discovered by the IRS agent, generally the IRS's voluntary correction programs (“VCP”) are not available. Instead, the plan sponsor will need to go through the IRS Audit Closing Agreement Program (“Audit CAP”), whereby the plan sponsor may correct any plan failures and pay a sanction. Should you find your plan under audit, don't fret. Empowering yourself with the knowledge of how the agency examination process works can assuage any concerns or fears of what to expect and any potential penalties that may be assessed.
